HiFi Technologies, Inc. Privacy Policy

This Privacy Policy is designed to help you understand what information we collect from you, why it is collected, and how you can manage, delete or export your information.


Introduction

We provide specialized Flight Simulation-Based Weather and Aviation Environment software and services designed to provide the best possible Flight Simulation experience, and to support your software and experience.  Our software and services include:

  • Weather Engine Software – Including Active Sky (ASP4, AS16, ASE)
  • Environment Graphics and Visual Enhancement Software – including Active Sky Cloud Art (ASCA)
  • Customer Service Help Desk – Provides an online portal to obtain Customer Service and Technical Support (http://support.hifitechinc.com)

Our software and services are offered to customers who purchase software licenses and/or wish to obtain support for their purchased software licenses, or to ask questions, obtain pre-sales support, or communicate with us.


Why we collect information

We collect information to provide usage of the software license purchased, to prevent unauthorized usage of software and licenses, and to provide support to our customers.

What information we collect

When you use our software, we monitor and store information including your IP address and a unique identifier that is tied into the device you are using.  This helps us ensure that the software works properly, with adequate performance for authorized licensed customers only, and prevents usage from unauthorized users.

When using our support services, we collect information such as your name and email address to verify your license and to provide the proper support based on the products you are licensed for, and to allow us to respond to you.

The information we collect when using our software includes unique identifiers, your license key, your active IP address, and for some of our software, your password and email address or username that you create and manage.  When some of our software crashes or experiences an error, an error report screen may appear, and customers may choose to send the error report from that screen, which includes your product software settings, usage logs, debug logs, simulator configuration settings and FSUIPC configuration settings (if installed).

The information we collect for support services includes your license key(s), active IP address, the email address you contacted us from (via email) or provide to us (via online helpdesk), the simulator/version you are using, and your full name and product names/versions you are requesting support for.

We collect information about your activity when using our software, to ensure that license violations and/or unauthorized usage does not occur.  This activity information includes your unique device identifiers, your active license key, your IP address and, for some software, your current password and email address/username.

We collect information about your location when using our software and services in the form of your IP address.

 

How we collect information

We use various technologies to store and collect information, including web server IP address identification, server logs, web-based cookies, and proprietary functions within our software that compiles and/or allows input of information and transmits this information to our servers.


How we use your information

We use your information to provide you with proper usage of your software licenses purchased, to provide you with support at your request, to prevent unauthorized users from using our services or accessing or modifying your account without authorization, and to interact and communicate with you directly.  For example, if we suspect an unauthorized usage of your account, or access from a new device, we may contact you to let you know and allow you to verify this usage.

Your consent will be asked for and obtained before we use your information for any purpose not listed above.

We store your information for no longer than required to provide ongoing online usage of software products, to provide support, to provide services that you’ve specifically requested, to comply with record keeping, accounting and tax regulations and/or comply with other regulatory requirements.

 

Cookies information

When you visit our Website, Forums, or Support System (services), we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets you log in faster and enhance your navigation through the site. Cookies and associated data may contain your IP address.  A cookie may also convey information to us about how you use our services (e.g., the pages you view, the links you click and other actions you take), and allow us or our business partners to track your usage of the Service over time. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of our services may not function properly if the ability to accept cookies is disabled.

Do Not Track Policy

California law requires that operators of websites and online services disclose how they respond to a Do Not Track signal. Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the website or online service that a user visits, indicating that the user does not wish to be tracked. Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

In the meantime, you may opt out of receiving interest based advertising from advertising networks that may be delivered on our platform and other websites by visiting the following websites. If you want to opt out of this online behavioral advertising, visit the following sites: http://www.aboutads.info/consumers and http://www.networkadvertising.org.

This will opt you out of many – but not all – of the interest-based advertising activities in which we or third parties engage. Choices you make may be browser and device specific. If you delete your cookies or use a different browser or a different computer or device, you may need to update your opt-out choices. Other third-party Sites provide visitors with the ability to opt-out of receiving interest-based ads on their Sites that you need to control through your settings on that Site. For example, to opt out of Google’s use of your online behavior for advertising purposes, visit Google’s Ad Settings page.


Minors and Children’s Privacy

Protecting the privacy of young children is especially important. Our Service is not directed to children under the age of 18, and we do not knowingly collect Personal Data from children under the age of 18 without obtaining parental consent. If you are under 18 years of age, then please do not use or access the Service at any time or in any manner. If we learn that Personal Data has been collected on the Service from persons under 18 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 18 years of age has obtained an Account on the Service, then you may alert us at support@hifitechinc.com and request that we delete that child’s Personal Data from our systems.

The Service is not intended to be used by minors, and is not intended to be used to post content to share publicly or with friends. To the extent that a minor has posted such content on the Service, the minor has the right to have this content deleted or removed using the deletion or removal options detailed in this Privacy Policy. If you have any question regarding this topic, please contact us as indicated in the “How to Contact Us” section. Please be aware that, although we offer this deletion capability, the removal of content may not ensure complete or comprehensive removal of that content or information.


Managing your information

Some of our software provides for input of your username (usually in the form of your email address) and password, which can be edited directly within the software (see the software’s User Guide for specific instructions).

Our online help desk provides account management functions when you’ve created an account and are signed in.  The help desk at http://support.hifitechinc.com allows you to change most of your information with simple easy-to-use account management links.

You may request, via our online help desk, or by e-mailing us at support@hifisimtech.com, to either obtain a copy of all of your personal information we have collected, to modify certain information, or to remove all of your information.  Requests are generally handled within seven (7) working days.

When you request to remove all of your information, the software will no longer continue to function.  This is because some information such as your license key, username, password and/or email address is required for operation.  Once the information is removed, it cannot be restored, and the software will permanently be disabled unless you purchase a new license.

Sharing of information

We do not share your personal information with any third parties except in the following cases:

  • We may need to verify your order and/or product name/version purchased, as well as collect detailed technical and configuration information to provide you with proper support, and may share and compare some of this information with contracted third-party support providers in order to do so.
  • We may need to verify your order and/or product name/version purchased to provide you with proper support, and may share and compare some of your information with the vendor/reseller you purchased a software license from.
  • We may need to meet applicable law, regulation, legal process or enforceable governmental request, and will provide information to verified entities requesting this information in such cases.
  • We may need to enforce our End User License Agreement, including investigation of potential violations, and may share certain information with appropriate entities in this regard if deemed reasonably necessary.
  • We may need to detect, prevent, or address fraud, security or technical issues, and may share certain information with appropriate entities in this regard if deemed reasonably necessary.
  • We may need to protect against harm to our rights, property or safety, and that of our customers, and/or the public as required or permitted by law, and therefore we may share certain information with appropriate entities in this regard if deemed reasonably necessary.
  • We may share information that is non-personally identifiable either publicly or with certain partners, such as publishers, third party network/service providers and developers.  For example, we may share our usage trends to potential additional network providers in order to identify the proper upgrade paths to ensure adequate performance of our software and services.


Your Rights if you are a
Resident of an EU Member State

We respect your privacy rights and provide you with reasonable access to the Personal Data that you may have provided through your use of the Services. If you wish to access, amend, or receive a copy of any Personal Data we hold about you, or to request that we delete or transfer any information about you that we have obtained from an Integrated Service, you may contact us as set forth in the “How to Contact Us” section. At your request, we will have any reference to you deleted or blocked in our database.

You may update, correct, or delete your Account information and preferences at any time. If you request that we remove your Personal Data, we will respond to its request within thirty (30) days. We will delete, amend or block access to any Personal Data that we are storing only if we receive a written request to do so from you who is responsible for such Personal Data, unless we have a legal right to retain such Personal Data. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. You may decline to share certain Personal Data with us, in which case we may not be able to provide to you some of the features and functionality of the Service.

The Service is hosted in the United States.  EU customers’ data will be hosted in one or more datacenters located in the United States.  If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you may be transferring your Client Data and Personal Data outside of those regions to the United States for storage and processing by our service providers. We will comply with GDPR requirements providing adequate protection for the transfer of personal information from Europe to the U.S. Also, we may transfer your data to the U.S., the EEA, or other countries or regions deemed by the European Commission to provide adequate protection of personal data in connection with storage and processing of data, fulfilling your requests, and operating the Service.

At any time, you may withdrawal your consent or object to the processing of your Personal Data, on legitimate grounds, except if otherwise permitted by applicable law. If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact us at support@hifitechinc.com. You also have a right to lodge a complaint with data protection authorities.

This provision does not apply to Personal Data that is part of Client Data. In this case, the management of the Client Data is subject to the Client’s own Privacy Policy, and any request for access, correction or deletion should be made to the Client responsible for the uploading and storage of such data into the Service.

This Policy is in compliance with the GDPR, and as such if any right granted to you under the GDPR is not explicitly expressed, you still have the right reserved.


What happens in the event of a change of control

If we are involved in a merger, acquisition, or sale of assets, we will continue to ensure the confidentiality of your personal information and give proper notice before any information is transferred or becomes subject to a different policy.


Data Security

We take reasonable and constantly-improving measures to ensure the security of your personal information.  These measures include encryption, firewalls, unauthorized usage detection, data obfuscation, and use of third-party security firms who detect and block attacks and other detrimental actions.  We also review our collected information and logs on a regular basis to detect and prevent unauthorized access to our systems. We restrict access to information to our staff and contracted support providers who need that information in order to process it, and anyone with access to this information is subject to strict contractual confidentiality obligations.


Changes to Privacy Policy

We change this Privacy Policy occasionally.  We will not reduce your rights under this Policy without your consent.  When we make changes, we’ll indicate when the changes were made and make this available to you via our websites and our software products.
